Terms of Service

Thank you for taking interest in my commissions!

Please take some time to read through my TOS before commissioning me as by commissioning me you are stating that you have read, understand and agree to my TOS. If you are uncomfortable with my TOS and/or are unwilling to agree you may not request a commission.

Please take note that these TOS may change at any time without notice.

There will be a change log at the end of the TOS to see what has changed and when.

Failure to adhere to these TOS will result in automatic denial of any future commissions and possible legal repercussions.

General terms

By commissioning me clients agree that the commission is for personal, non-profit use unless otherwise stated and the commercial use fee discussed has been paid
If shared in person or online the client must give proper credits to me as the artist.
The client must be able to pay through any of the payment options I have listed on my website and commission form in order to commission me.
I reserve the right to refuse or discontinue work on a commission at any time.
Prices are subject to change depending on additional details and the complexity of the commission.
The use of my work to promote or be within any kind of cryptocurrency or NFT is strictly prohibited.
Under no circumstances will my work be allowed to train or develop any kind of machine learning or generative AI model. Additionally, I do not allow my work to used to endorse, advertise, or benefit AI technology in any kind of way.
Any commissioned artwork may not be modified (besides aspects such as cropping or resizing) by anyone but myself.
I retain all copyright to my works, which includes but is not limited to the right to use the image as an example of my work, self promotion such as on social media and use in my portfolio. A request for the commission to remain private during and after the completion of the commission may be submitted but will incur a fee as listed in the 'additional fees' section of my TOS.
Any communication during the commission must be done in English. Any miscommunication as a result of mistranslation is at the fault of the client if they're unable to communicate in English.

Payment

All listed prices are in USD and all payments will be done in USD. It is the client's sole responsibility to make any currency conversions.
Payment can be accepted through Square
Do not send me any money until it has been agreed I will begin work on the commission and have requested payment
Commissions will be paid 50% upfront and the remaining 50% will be paid upon approval of the sketch
I will only begin work on the commission once I have received the 50% upfront payment

Refunds

If the commission is canceled after paying the 50% upfront payment but before I have started work on the initial sketch I can give a partial refund (25% of the full payment)
Once the sketch has been approved and the remaining 50% has been paid any refunds will based on the total time spent on the commission (minimum refund of 50% of full payment)
There will be no refunds issued for completed work
I reserve the right to be able to cancel the commission and refund your money at any time.
Failure to pay the remaining 50% in a timely manner after the initial sketch has been sent will render the commission null and void. As a result I will be able to use the partially-completed commission in any way I wish.
Charge backs at any point during or after payment is not permitted, if you issue a charge back you will lose all rights to the commissioned work.

Additional fees

A design fee of +25% of the original price will be charged if there are no reference images and the client wishes me to draw solely from a description or collection of images.
A fee of +20% of the original price will be charged for any additional major changes or revisions. It is up to my discretion what counts as a major change. This fee must be paid before I begin work on any desired changes.
A fee of +8% the of original price will be charged for any additional minor changes or revisions. It is up to my discretion what counts as a minor change. This fee must be paid before I begin work on any desired changes.
If the client wishes that the commission remain private during the work on the commission a fee of +7% of the original price will be charged. Additionally, if the client wishes the commission to remain private after completion of the commission an additional fee will be charged dependent on the amount of time the client wishes the commission to remain private. (minimum of +30% of the original price) If the client wishes for the commission to remain private for an indefinite amount of time a fee of +50% of the original price will be charged. This request for the commission to remain private and for how long must be stated during the ordering process.

Process

The time taken to complete the commission will be dependent on the type and complexity of the commission. The exact time taken to complete the commission will be discussed upfront.
Deadlines are acceptable but must be discussed upfront. A minimum of 7 days from the time the order is accepted is required, a commission with a deadline of less than 7 days from the time the order is accepted will be refused.
Once the request has been discussed and accepted I will only begin work on the commission once I've received the 50% upfront payment.
Once I have been completed the sketch it will be sent to the client for any revisions, if revisions are needed the modified sketch with the client's desired revisions will be sent in for approval.
After the sketch has been approved the client will send in the remaining 50% before I start the remaining work on the commission.
I will additionally, dependent on the kind of commission, I will send in the commissioned artwork at multiple stages for revisions or changes.
Once the commissioned artwork has been finished I will send in the artwork for 3 minor revisions.
Once the finalized work has been accepted I will send a watermarked full resolution image. Please keep in mind that there will be no physical products sent

Revisions

I allow 3 major revisions during the sketch stage, additional major revisions will incur a fee as listed in 'additional fees'
Any major revisions after the sketch has been approved will incur a fee as listed in 'additional fees'
Over the duration of the commission I allow 5 minor revisions, additional minor revisions will incur a fee as listed in 'additional fees'
Any revisions that are a result of my own negligence will be free.

Copyright and useage

Artist

I the artist retain any copyrights over any commissioned work
I reserve the right to watermark and/or sign my work
I will not claim the rights to any character designs unless it is one of my own designs
I reserve the right to be able to post commissioned artwork in places including but not limited to, online and in my portfolio unless the client has paid a fee stating that they wish for the commission to remain private
I will not profit further from the finished commissioned artwork unless the client breaks any of my Terms and Conditions
I reserve the right to cancel or refund the order at any time and for any reason.

Client

You may not alter the commissioned work without my consent
You retain the rights to the intellectual property (IP)
You may not use the commissioned art for commercial purposes*
You must give credit to me when sharing or using the commissioned work
You may print or create a physical reproduction of the artwork as long as it is for personal use only.*
You may not claim the commissioned work as your own

*In some cases the rights to use the commissioned work may be purchased

Commercial use & licenses

If the client wishes to order a commission for commercial use the total price of the commission, fees and any possible royalties will be discussed upfront.
If the client wishes to use the commission for commercial use it will incur a fee dependent on what the client wishes to use the commission for with the minimum price increase being +100% of the original price of the commission.
Commercial use includes but is not limited to: reproducing and selling publicly or privately, such as for merch; use on a platform or medium you will receive profit from where you have posted my work, such as on a business card or a personal website.
If the client wishes to use the commissioned art for merchandise the client will only be able to produce a limited amount of products using my work that will be discussed upfront. If the client wishes to produce more than discussed after the commission has been completed the client will need to pay a fee dependent on how many more products the client wishes to sell.
Credit is still required when using the commissioned art commercially
